DESCPRIPTION
Bisphenol A was originally added to the Proposition 65 list on 11 April 2013 for reproductive toxicity. The chemical was delisted on 19 April 2013 due to a trial court injunction prohibiting the listing for developmental endpoint pending a court case brought by the American Chemistry Council (ACC). After losing the case, the ACC appealed, and the injunction was kept in place by the Appeals Court until the case was resolved. On 19 November 2020, the Appeals Court upheld the original trial court decision and issued an order dissolving the injunction. OEHHA reinstated the developmental endpoint listing of BPA as causing reproductive toxicity, effective 18 December 2020.

IMPACT
Due to the listing of BPA on regulatory sites across the world over the last eight years, along with BPA being banned outright in certain applications, most producers and converters have removed the chemical from their products or switched to BPA alternatives. As of 18 December 2020, items marketed in California which contain Bisphenol-A must be labelled with a warning for the Developmental Toxicity endpoint. BPA was previously listed in 2015 under the Female Reproductive Toxicity endpoint.
